BG Charge Systems welcomes you in its platform, created specifically for your needs and searches, offering you a wide range of products and services in the field of car charging stations. BG Charge Systems , as well as our partners, will do our best to provide you with fast and quality service related to the purchase, installation and servicing of charging stations for electric vehicles, service services offered by us and our partners, as well as publication of advertising, marketing materials, etc. In connection with the services provided BG Charge Systems processes personal data in accordance with the Privacy Policy ("Policy") that you can familiarize yourself with. The Privacy Policy as well as the Cookie Policy and other similar documents form an integral part of BG Charge SystemsTerms and Conditions and you can find them on www.bgcharge-systems.com

1. Registration

1.1. "BG Charge Systems" Ltd., VAT: 206534333, with headquarters and address of management in 1729 Sofia, Mladost district, Mladost 1A, 506A, 2 ent., 4th floor4. (BG Charge Systems) is a commercial company that deals with the import and distribution of stationary and mobile charging stations for electric vehicles, accessories and components for them. It provides through the site www.bgcharge-systems.com and mobile versions (the "Site") of natural and legal persons ("you") free information society services ("Services"). Services include, but are not limited to, search, viewing, receiving information about stationary and mobile stations for electric vehicles, installing and servicing them, brands and models of electric cars, service services, etc.

1.2. Access to the Site is free and users (registered or unregistered) can view information about services and products free of charge. BG Charge Systems reserves the right and may in the future introduce certain fees for access to its various services.

1.3 Registration as a private person is carried out in person and registration on behalf of others is not allowed, as well as if you are under 18 years of age and/or incapacitated. When registering a private person, information such as: name, mobile phone, email and other information specified in the registration form is required. We use this data only in the manner provided for in the Privacy Policy.

1.4. The registration of a company account is carried out by an active person who declares that he is authorized to represent the company, including to accept these Terms and to perform actions related to the use and management of the company account on behalf of the company. When registering a company account, a name, VAT, administrative contact person, contact telephones, address and other information specified in the registration form are required. We use the personal data, some of this information, only in the manner provided for in the Privacy Policy.

1.5. You undertake to provide correct, complete and up-to-date data upon registration and to maintain them. In case of incorrect, incomplete or outdated data, you should correct them immediately. In case of detection of incorrect, incomplete and/or outdated data BG Charge Systems reserves the right to suspend your access to the services until the rectification of irregularities.

1.8. In addition to the data completed upon registration, BG Charge Systems reserves the right, if necessary, to request the submission of additional documents and information for additional identification when activating the account or at any time there are doubts about the correctness, timeliness and completeness of the data provided.

1.9. You are responsible for all actions performed through your account using your username and password to access. You undertake to immediately notify BG Charge Systemsin case of improper access or probability of such access to your account

1.10. By clicking on the "Register" button, you or the company you represent make an electronic statement agreeing to and obligating to use the Services of BG Charge Systems under these Terms. Before pressing the "Register" button, you have the opportunity to view and edit the information you specified. 

1.11Some of the Services are also provided without the need for registration. In such cases, consent to these Terms shall be expressed by the mere commencement of use of the Services.

Use of the Services and content on the Site

2.2. The site and its content are owned by BG Charge Systems and/or its partners, suppliers and customers. You may use the content for informational purposes and/or to make contact with those offering the relevant services and/or products. You may not use this content for any purpose other than with our express consent and/or the consent of the third parties concerned.

2.3. BG Charge Systems and its partners make serious efforts to maintain the accuracy of the information presented on the Site. However, given the possible technical errors or omissions in this information, BG Charge Systems and its partners specify that the images of the products are illustrative and guiding in nature, respectively the services and products supplied may differ from the images.

2.4. You undertake not to use the intended means of communication with other users for purposes other than the purpose of the Site. 

2.5. You undertake not to disturb and disrupt the normal operation of the technical or software applications and computer systems of BG Charge Systems or users of the Site through bad faith actions.

Services 

3.1. BG Charge Systems provides a platform for users to discover goods /or services according to their interests and needs. BG Charge Systems provides users with information about each or all of the following services and products:

• Charging stations for electric cars;
• Services related to installation and installation of charging stations;
• Management and operation of chargers;
• Information about brands and models of electric cars;
• Service services for electric cars;
• Promotional materials related to user preferences;
• Other information related to electric vehicles.

All of the above services and products are provided at the discretion of BG Charge Systems and you agree that BG Charge Systems may add or provide additional services that are not listed above or may remove/suspend or terminate any or all of the services/products listed above without notice and/or without liability.

Features and content

4.1. "Content" means any information, data, text, software, music, sound, photos, graphics, video, messages, news, notices, articles, contracts, forms, documents or other materials that may be viewed or downloaded on or through this Site. The content also includes any e-mail, message or any other information provided by a user to be displayed on the Site by BG Charge Systems.

4.2. BG Charge Systems may allow the user of the Site to upload or publish certain content, data or information, message, files, photos, articles, feedback or any other material available to other users or for communicating. Some of these tools may be provided by partners/third parties and their use is subject to both these General Terms and Conditions and the policies of partners/third parties. This feature is available to you to meet personal needs and to be able to express your opinion about products/services available through or on the Site.

4.3. You undertake not to post content of an illegal, discriminatory, obscene, offensive, threatening, defamatory, hateful or obscene nature, as well as one that could embarrass, offend a good name, offend a third party or reveal a legally protected secret. In the event that content infringes any patent, trademark, trade secret, copyright or other intellectual and/or industrial property rights or privacy rights of any third party or is contrary to applicable law, then BG Charge Systems may, at its sole discretion, remove or disable access to the content or any part thereof, without prior notification to the user. In the event that a third party takes part in the published content, including through its visual presentation, you declare that you have its prior consent, and BG Charge Systems shall not be liable if it is established that there is no such thing.

4.4. As a content creator, you are fully responsible for everything you upload, post, transmit or otherwise provide on the Site. You acknowledge and agree that the content posted or transmitted through our Site represents the views of the author and not BG Charge SystemsYou also acknowledge that the use of this content is at your risk. You warrant that you have the right to use any content you post on the Site or send to others through the Site, and that it does not conflict with these Terms or the law. In case this is not the case, you are liable for any damages that may result from this to BG Charge Systems or to third parties.

4.5. In order to ensure the reliability and security of the Services, BG Charge Systems reserves the right to seek assistance from the competent authorities in case of gross violations of these Terms.

4.6. You give BG Charge Systems the right to make other publicly published advertisements available to the general public, which is for the purpose of providing the Services and for which BG Charge Systems owes no remuneration.

4.7. By posting content on the Site, you grant other users the right to access and use it in accordance with these Terms of Use and in accordance with the law.

4.8. Without limitation in time, BG Charge Systems reserves the right, but not the obligation, to audit the content available on the Site or any other material or information published/uploaded by the User. If, at its sole discretion, BG Charge Systems decides that certain content or any other material on the Site is contrary to any law or the Terms, as well as in case of violation of the privacy of any person, then BG Charge Systems may either remove, edit, or block such material without any notice. Notwithstanding the above law, you acknowledge that all content is solely the responsibility of the person from whose account it originates. This means that you, not BG Charge Systems, are fully responsible for all content you upload, post, transmit or otherwise provide through the Site. In addition, you acknowledge and agree that this content does not necessarily reflect the views of BG Charge Systems, nor does BG Charge Systems approve such user content. In addition, we inform you that BG Charge Systems may share information relating to specific violations with the relevant state and local authorities in order to verify the identity of the user in order to stop the violation and/or remedy its consequences. Therefore, we warn you not to be involved in any activities or abuses that violate applicable law, rules, regulation or violate these Terms.

Users profile and options for registration

5.1. The user has access to the Site or other information and materials in two ways: as a guest, without the need for registration or after registration, in which a user profile is created. Some features and information on the Site are available to all users – for example, the user can freely do surveys and compare the products and services available on the Site. However, guest services are limited, which means that not all features or functionalities are available until the user registers/creates a profile on the Site. The registration/creation of an account on the Site takes place after the provision of certain information, e.g. Subject to our user profile creation guidelines and any other applicable law, BG Charge Systems recognizes you as a registered user, allowing you to access through your account, use the Services and access other features and information that are not available to guest users.

5.2. If you use the Services or access our Site as a registered user, you acknowledge and agree that you are fully responsible for maintaining confidentiality, will not disclose your account data to any other person and that you are personally responsible for any activity carried out by your account.

5.3. You agree that as long as you register/create your account with us, you will not provide information that is incorrect, inaccurate or out of date and you will not use the data of another person or account of another user. BG Charge Systems may suspend/delete your account or restrict/deny access to the Site or Services at any time if it is found that your information is incorrect, inaccurate, out of date or applies to another user's account.

Obligations of the consumer

6.1. Subject to all applicable laws, terms and conditions of these General Terms and Conditions, BG Charge Systems grants the User a limited, non-exceptional, non-licensed, non- transferable, devocable and limited permission to access and use the Site and services provided through or on it.

6.2. You acknowledge, acknowledge and undertake that the use of the Site will be strictly governed by these Terms and the following mandatory principles:

6.2.1. You will not use or access the Site or take advantage of the Services in any way other than through the interface provided by BG Charge Systems.

6.2.2When you use the Site and/or Services, you undertake not to display, upload, modify, publish, transmit, update, delete or share any content that:

• Belongs to another person and you have no rights over it;
• Is illegal, discriminatory, obscene, offensive, threatening, defamatory, hateful or obscene, as well as one that could put a person in an awkward position, harm the good name, insult or inflict any harm on a third party;
• Infringes patents, trademarks, copyrights or other intellectual and/or industrial property rights;
• Violates the applicable laws and regulations in force in the Republic of Bulgaria and beyond;
• Bulgaria and outside;
• Is provided for another person or company;
• Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or restrict the functionality of any computer resource;
• Threatens the unity, integrity, defense, security or sovereignty of the Republic of Bulgaria, friendly relations with foreign countries or provokes incitement to commit a crime or prevents the investigation of such;
• Prevents or interrupts access to the Site and/or Services by participating in sending emails type „junk/phishing“, „спам“ or the like;
• Tries to gain unauthorized access to the account of another user, the Site, any other systems or networks associated with the Site, or any computer resource(s) of BG Charge SystemsYou may not access the Site, features or any of the Services by hacking, retrieving a password or other illegal means or by automated means..

6.3. BG Charge Systems may, during a certain period of time, provide access to limited offers/vouchers in order to promote the Site and achieve greater user engagement. As a user, you acknowledge and agree that you will strictly comply with the general terms and conditions of use of the relevant vouchers/offers, as appropriate, which are in addition to these Terms.

7. Intellectual property

7.1. All text, graphic, audio, design and other works on the Site are intellectual property objects of BG Charge Systems and/or its partners. The content of the Site is intended for personal use only, unless otherwise permitted. Any change in the materials or the use of the materials contained on the Site for any commercial purposes is a violation of the copyright of BG Charge Systems and/or their respective media. By accepting these Terms, you acknowledge and agree that you will not copy, reproduce, post, upload, transmit, destroy or distribute the content available on the Site without prior permission from BG Charge Systems.

7.2. The Site may contain certain trademarks, logos or signs ("Marks"). These Marks are the property of BG Charge Systems and/or its partners or third parties. You are not allowed to use the Marks in any way without first receiving the written permission of their respective holder.

7.3. Any use of the Site, content, marks or other intellectual property rights of BG Charge Systems , contrary to the requirements of these Terms or any applicable law, constitutes a violation of the intellectual property rights of BG Charge Systems or of the relevant third party/partner. Upon identification or suspicion of an intellectual property infringement of BG Charge Systems or a third party/partner, we may and will initiate the relevant legal proceedings and/or take other appropriate action against the infringers.

7.4. BG Charge Systems holds all intellectual property rights and trademarksBG Charge Systemsand the Site, including copyright and related rights, patents, utility models, designs, know-how, trade secrets and inventions, reputation, code, databases, text, content, graphics, icons and hyperlinks.

Correspondence

8.1. All communications and notifications between the parties in connection with the implementation of the Terms shall be made in writing or by e-mail. 8.2. The Parties agree that in the relations between them arising out of these Terms, any written notice and other correspondence sent by e-mail shall be deemed to have been duly received by the party to which they are addressed and shall have the legal consequences associated with receipt if there has been a change in the specified correspondence address of the party concerned and the other party has not informed the other thereof in due time.

Final provisions

9.1. Due to the fact that the Services can only be used in accordance with the current Terms, we notify you that we do not have the technical ability to grant you access to the Services on the Site in case you do not agree with them. If you do not agree to the Terms, please stop using the Site. If you wish, you have the opportunity to close your account and terminate the use of services from the Site.

9.2. Any invalidity of any of the provisions of these General Terms and Conditions shall not result in the invalidity of the entire document.

9.3. In case of conflict between these General Terms and Conditions and arrangements in a special/individual contract between BG Charge Systems and users, the clauses of the individual contract shall prevail.

9.4. These General Terms and Conditions shall enter into force for all users of the Site from the day of their publication.

9.5. For the issues not settled in these Terms related to the use of the Site by users, the provisions of the legislation in force in the Republic of Bulgaria shall apply.
