BG Charge Systems Ltd. , VAT: 206534333, with headquarters and address of management in 1729 Sofia, Mladost district, Mladost 1A, 506A, 2 ent., 4th floor "(BG Charge Systems)" is an administrator and processor of personal data, and compliance with the legislation on personal data protection is a priority and ethical value for us. We take all necessary actions to ensure that your personal data is processed safely, securely and in accordance with the requirements of the applicable Bulgarian legislation and the General Data Protection Regulation (Regulation (EU) 2016/679 - GDPR).

With this Privacy Policy, we would like to inform you what personal data we collect and for what purposes, how we use and store it, what are the cases in which we make it available to third parties and who they are, as well as the conditions for the processing of personal data, the organizational and technical measures we have taken to ensure their security and privacy.

BG Charge Systems reserves the right to change and update this Privacy Policy in order to ensure compliance with Bulgarian and European legislation.

2. Principles and policies for collecting, processing and storing your personal data.

BG Charge Systems is committed to complying with the following policies and principles when processing personal data:

  • Legality, good faith and transparency;
  • Restriction of processing purposes;
  • Accuracy and timeliness of the data;
  • Restriction of storage in order to achieve the objectives;
  • Integrity and confidentiality of processing and ensuring an appropriate level of security of personal data.

3. Categories of personal data that BG Charge Systems processes

BG Charge Systems collects and processes only the personal data that are specifically needed to fulfill each of the following purposes and in the presence of the necessary grounds.

  • Contact details when registering on the platform: name and contact address, contact phone number, e-mail;
  • EGN and ID card data, when necessary;
  • When you visit our website, our web servers temporarily record and store for security purposes the connection data of the computer that connects to our site, the web pages you visit on our site, the date and duration of the visit, the identification data of the type of the browser and operating system used, as well as the website through which you connected to our site;
  • Tax and insurance information, when necessary;
  • Bank account, when the person has made a payment by bank transfer;
  • Data arising from the current contract - purchased goods and / or services provided, as well as additional / clarifying information provided by you; 
  • Mandatory requisites, according to the current legislation of the Republic of Bulgaria for issuing a tax invoice to individuals, only and only at the explicit request of the client within the statutory deadline

4. Grounds for collecting, processing and storing your personal data

BG Charge Systems collects, processes and stores your personal data on the following grounds:

  • A contract under which you, or a company represented by you, are a party, including for actions prior to and conditional on the conclusion of a contract and undertaken at your request (in respect of all contracts concluded with BG Charge Systems , including those not inexhaustingly listed: contracts for the provision of advertising services, licensing agreements, employment and civil contracts, contracts for the use of a website and/or mobile application, including with users, service contracts, for workmanship, commission contracts, as well as any other contracts not forbidded by law, whether in writing or whether they have been concluded at an attendance or at a distance, by telephone or through the use of an information system); or
  • Fulfillment of our legal obligations (for accounting, tax, social security and other administrative obligations to state and/or municipal authorities and institutions); or
  • Realization of our rights and interests when they have a reasonable advantage over the interests of the data subjects (for engaging in civil, criminal or administrative liability in case of contractual non-compliance, committing violations and/or crimes); or
  • For the purposes of our legitimate interest (fulfillment of legal obligations and ability to identify perpetrators of unlawful acts harming us or others); or
  • Explicit consent provided by you (in all other cases not mentioned above).

5. Purposes for collecting, processing and storing your personal data

BG Charge Systems stores and processes your personal data for the following purposes:

  • To manage your requests/orders (e.g. for information, charging station, charging station installation, design or other service);
  • To manage the commercial relationship with you;
  • To contact you for customer satisfaction surveys or market research on the goods and services we offer;
  • For better service and elimination of problems in the execution of a contract concluded with you and/or registration of an account on the website of BG Charge Systems
  • To send you, with your consent, personalized marketing messages, product and service news, special offers, invitations to events or games, competitions, etc.;
  • In order to manage your legal claims and protect our legitimate interest, including protection, safety and dispute resolution. BG Charge Systems may store and process your data to protect the systems it has used to detect and prevent fraud where applicable law so requires;
  • To respond to your request in connection with the exercise of your rights;
  • To fulfill the obligations of BG Charge Systems to the National Revenue Agency (NAP), Ministry of Interior Security (MVR), the National Security Agency (DANS) and other state and municipal authorities, as well as to respond to requests for information from the national regulators (KRS, KZP, KZLD) in connection with complaints or other procedures filed with these authorities, as well as to provide them to other state authorities or law enforcement services for administrative control purposes, prevention and detection of offences and offences.

6. Deadlines for collecting, processing and storing your personal data

BG Charge Systems stores and processes your personal data under the following deadline requirements:

  • Your personal data are processed and stored for the time necessary to secure all rights and obligations arising from the contracts referred to in the above section: i.e. for the time of the order and/or delivery of a particular good or service, the statutory claim period and until the expiry of the limitation periods provided for in the legislation (including for in commitment of administrative criminal responsibility), applicable to the transaction concerned;
  • Your personal data as users of BG Charge Systems website(s) is collected and processed during the period of validity of the concluded contract under general terms and conditions (i.e. for the duration of your registration). Upon termination of your registration,BG Charge Systems deletes all your personal data, except for the required personal data within the deadlines under the Electronic Commerce Act, the Electronic Communications Act, the Obligations and Contracts Act, the Consumer Protection Act, the Personal Data Protection Act, the General Data Protection Regulation, only for the purposes of compliance with the administrative and contractual obligations of BG Charge Systems but for no more than 5 years (total limitation period under Art. 110 of the Obligations and Contracts Act);
  • For the time during which BG Charge Systems is obliged to store your personal data in accordance with mandatory regulations, accounting documents – invoices, etc., issued by BG Charge Systems , they will be archived for the period provided by law. BG Charge Systems stores the personal data it needs to keep under applicable law for the relevant period, which may exceed the period for which the contractual relationship is valid;
  • Consent to marketing proposals and other initiatives requiring your explicit consent is valid until its explicit withdrawal. Where consent is withdrawn, the user data shall be deleted from the relevant databases;
  • BG Charge Systems will notify you in case the data retention period needs to be extended in order to fulfil the objectives, performance of the contract, in view of our legitimate interests or for any other reason that arises. In other cases, the processing time is determined by the processing purpose or set by the regulatory requirements.

7. Who has access to your data?

We may share your information when we cooperate with other companies, as well as with our partners or service providers, by processing your personal data in part or in full, only to the extent necessary to perform the specific tasks assigned (e.g. to provide services related to sending marketing information, conducting research, etc.).

As far as possible, we store your information on servers located within the European Union and/or the European Economic Area. When storing information on servers not belonging to BG Charge Systems and/or located in other countries, BG Charge Systems takes action to encrypt all personal data in a way that prevents unauthorized persons from accessing.

Some of these countries may have data protection legislation other than that of the European Union. In these cases, we pay particular attention to bringing such transfers of personal data into line with the applicable General Data Protection Regulation and to take the same safeguards with regard to the protection of your privacy, rights and freedoms as those proposed by the European Union (in particular by using the European Commission's Standard Contractual Clauses).

Last but not least, we may need to share your personal data with third parties if required for the purpose of compliance with a legal obligation or administrative or judicial decision, namely:

  • For accounting, legal or human resources services of a third party with which BG Charge Systems has concluded the relevant contracts;
  • Data may be provided to the National Revenue Agency (NAP), National Insurance Institute (NOI), the National Security Agency (DANS), the Ministry of Interior Security (MVR), the Traffic Police (KAT) and other statutory recipients, where the applicable legislation so requires.

8. How we store your personal data

Taking into account the level of progress in the field of communications and technology and regulatory requirements, BG Charge Systems has taken the necessary technical and organizational security measures against unauthorized and unlawful processing, accidental loss, destruction or damage to personal data as may be required.

We organize and conduct trainings of our employees regarding the policies, principles and procedures for the protection of personal data and require them to strictly comply with them.

9. Your rights

You have the following rights:

  • right of access to your personal data - this means the right to receive information from BG Charge Systems about whether your data is being processed and on what basis this happens, and in cases where access to the data itself is applicable, which means to receive a copy of your data;
  • right to rectification and right to erasure/rectification – this means the right to request rectification of inaccurate and/or incomplete data, as well as erasure of data where this request is legitimate;
  • right to restriction of processing - this means the right to request restriction or termination of processing when the request is legitimate;
  • ght to portability – this means the right to receive data in a structured, widely used and machine-readable format in order to transfer the data to another data controller;
  • right to object - this means the right to object to the processing of the data when the request is legitimate, including the right to object to the sending of marketing information.

You also have the right to lodge a complaint with the relevant data protection supervisory authority. We recommend that you contact us before you file a complaint, and we will try to resolve any problem or concern you have.
